1. Acceptance of Terms

By downloading, installing, or using Obsession GPS Tracker ("the App"), you agree to these Terms of Service. If you don't agree, don't use the App. These terms apply to both Free and Premium tiers.

2. Description of Service

Obsession GPS Tracker is a GPS tracking app for treasure hunters, metal detectorists, and outdoor enthusiasts. The App provides:

• Free Tier: GPS tracking, waypoints, photos, route planning, session export
• Premium Tier: Land ownership data, activity permissions, trail data, real-time alerts, offline caching

3. Subscription Terms (Premium Only)

3.1 Pricing

Premium subscription is offered at:

• $ Annual Plan: $49.99 USD per year
• $ Monthly Plan: $6.99 USD per month

Prices may vary by region and are subject to change. You'll be notified of price changes before renewal.

3.2 Free Trial

We offer a 7-day free trial for Premium. You won't be charged during the trial. If you don't cancel before the trial ends, you'll automatically be charged for the subscription period you selected (annual or monthly).

3.3 Auto-Renewal

Subscriptions auto-renew at the end of each billing period (annual or monthly) unless you cancel. You'll be charged 24 hours before renewal. Manage your subscription in your App Store (iOS) or Google Play (Android) account settings.

3.4 Cancellation

Cancel anytime through your App Store or Google Play account. Cancellation takes effect at the end of your current billing period. You'll retain Premium access until then. No refunds for partial periods.

3.5 Refunds

All payments are processed by Apple/Google. Refund requests must go through them. We don't control or process refunds directly. See Apple's refund policy or Google's refund policy.

4. User Responsibilities

4.1 Legal Compliance

You are responsible for complying with all laws and regulations related to treasure hunting, metal detecting, and land access, including:

• • ARPA (Archaeological Resources Protection Act)
• • State and local trespassing laws
• • Property rights and land access regulations
• • Permit requirements for federal/state land

Obsession GPS Tracker provides information to help you stay legal, but YOU are responsible for your actions. Always verify permissions independently.

4.2 Government Non-Affiliation Disclaimer

We source land ownership data from publicly available government databases. Original sources include:

• • PAD-US: U.S. Geological Survey (usgs.gov)
• • National Forests: U.S. Forest Service (fs.usda.gov)
• • Public Lands: Bureau of Land Management (blm.gov)
• • National Parks: National Park Service (nps.gov)
• • Wildlife Refuges: U.S. Fish & Wildlife Service (fws.gov)

4.3 Data Accuracy Disclaimer

While we source data from authoritative government databases, please note:

• • Data may be outdated or incomplete
• • Property boundaries may not be survey-accurate
• • Activity permissions may change without notice
• • GPS accuracy varies based on terrain and satellite visibility

Always verify permissions with landowners or land management agencies before detecting.

4.4 Prohibited Uses

You may NOT use Obsession GPS Tracker to:

• ✕ Violate any laws (trespassing, ARPA, etc.)
• ✕ Harass or stalk individuals
• ✕ Damage property or natural resources
• ✕ Reverse engineer, decompile, or hack the App
• ✕ Scrape or mass-download land ownership data

5. Limitation of Liability

IMPORTANT: By using Obsession GPS Tracker, you acknowledge:

• • You assume all risks of outdoor activities (trespassing, injury, property damage, ARPA violations, etc.)
• • We are not liable for inaccurate data, GPS errors, or your actions based on App information
• • We are not liable for fines, criminal charges, lawsuits, or damages resulting from your use of the App
• • Maximum liability: Limited to the amount you paid for Premium subscription in the past 12 months (if any)

The App is provided "AS IS" without warranties of any kind. We don't guarantee accuracy, completeness, or reliability of land data.

6. Intellectual Property

Obsession GPS Tracker and all content, features, and functionality are owned by Edibu LLC and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of your tracking data, photos, and waypoints. You grant us no rights to this data. We don't store it on our servers (privacy-first architecture).

7. Account Termination

We reserve the right to suspend or terminate your access to the App (including Premium features) if you:

• • Violate these Terms of Service
• • Use the App for illegal activities
• • Abuse or overload our backend services
• • Attempt to hack or reverse engineer the App

Termination for violations does not entitle you to a refund.

8. Third-Party Services

Obsession GPS Tracker integrates with third-party services:

• • Apple App Store / Google Play: Subscription payment processing
• • RevenueCat: Subscription management
• • Mapbox: Map tile rendering

These services have their own terms of service and privacy policies. We're not responsible for their actions or policies.

9. Changes to Terms

We may update these Terms of Service to reflect changes in our practices, legal requirements, or new features. We'll notify you via the App or this website. Continued use after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes will be resolved in Delaware courts.
